Bonus Gift Card Offer - redeemable for online, phone and mail order purchases

1. This promotional offer is for a $500 valued digital prepaid Visa e-gift card supplied by an authorised third party, which can be redeemed for online, over the phone or mail order purchases. Upon the Promoter’s acceptance of an order of an Eligible Product, you accept the terms and conditions of this promotion.

2. Purchases made between 12:01am AEDT 10^th November 2022 and 11:59pm AEDT 21st November 2022 (“Offer Period”) of the following Sony qualifying models will be eligible to receive a $500 valued digital prepaid Visa e-gift card, which can be redeemed for online, over the phone or mail order purchases (“Bonus Gift Card”) subject to these Terms and Conditions: KD75X85K, XR75X90K, XR75X95K, XR77A80K, KD85X85K, XR85X90K, XR85X95K, XR83A90J (“Eligible Product”).

3. Offer is only available during the Offer Period.  Where an Eligible Product appears in the checkout process as “Add to Order for Next Shipment” (product is on back order) these purchases are eligible for the Bonus Gift Card as long as the purchase is made during the Offer Period.     

4. Offer is available at Sony Online Store (https://store.sony.com.au) & at Sony Stores Chatswood, Castle Hill & Parramatta.

5. Offer is available for personal use only and not for re-sale, commercial or leasing purposes. Claims are only open to Australian residents who are 18 years and older. Claimants under 18 years old must have parental/guardian approval to claim and further, the parent/guardian of the claimant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor submitting a claim in this promotion.

6. Sony staff pricing is not applicable to this promotion.

8. Purchases will be automatically validated and you will not be required to submit a claim to receive the Bonus Gift Card.  The Bonus Gift Card will be delivered via email to the email address recorded on customer’s Sony Store Australia customer profile used to create their eligible order. Delivery of the Bonus Gift Card will be delivered to the claimant within 5-7 weeks from order shipment date.

9. If, due to an error by the successful claimant, the Promoter issues the Bonus Gift Card to the wrong email address, the Promoter will not be responsible or liable to the successful claimant to reissue a replacement Bonus Gift Card to the successful claimant in order to rectify the error. The successful claimant agrees that he or she will not bring a claim against the Promoter, its employees, directors, agents and, or contractors (including its related bodies corporate and/or its related bodies corporates’ employees, agents or contractors) to recover the Bonus Gift Card funds mistakenly sent to the wrong email due to the error of the successful claimant.

10. If for any reason a valid claimant does not supply their email address at the time of their order, then the Bonus Gift Card may be forfeited. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.

11. The Bonus Gift Card is subject to the following terms and conditions:

a. The Bonus Gift Card can be used for purchases of goods and services online, over the phone or for mail orders where prepaid VISA e-gift cards are accepted and processed electronically (not at merchants and merchant groups who elect not to accept VISA prepaid e-gift cards).  The Bonus Gift Card can only be used online, over the phone or for mail orders.   The Bonus Gift Card cannot be used for card present transactions at merchants where a swipe, insert or Paywave is available.

b. The Bonus Gift Card must be registered prior to being used.  Failing to register the Bonus Gift Card will result in the Bonus Gift Card being inactive.

c. To use the Bonus Gift Card online, over the phone or for mail orders, you will need to provide the merchant you wish to pay with the Account holder name, Account number, expiration date and CVV code, all of which are shown on the Reference Card sent to you by email.

d. The Bonus Gift Card is not reloadable, and is valid until the date shown on the Reference Card sent to you by email. Any remaining available balance will be forfeited on the expiry date.

e. This Bonus Gift Card cannot be used at the following merchant category groups; Automated Fuel Dispensers (5542), Gambling transactions (7995), Financial Institution–Automated Cash Disbursements (6011), Financial Institution–Manual Cash Disbursements (6010), Financial Institution–Merchandise And Services (6012), Quasi Cash–Merchant (6051), Securities–Brokers and Dealers (6211), Wire Transfer Money Orders (4829).

f. The Bonus Gift Card cannot be redeemed for cash, reloaded, returned for a refund, have its balance consolidated to a new gift card, or be replaced or extended after expiry (3 years after gift card generation) or have its value replaced after expiry and is not legal tender, an account card, a credit or debit card or a security. The Promoter is not responsible should the Claimant fail to redeem the Bonus Gift Card issued to them within the specified timeframe.

h. The issuer of the Bonus Gift Card is Indue Ltd ABN 97 087 822 464 (‘Indue’). Blackhawk Australia Pty. Ltd. ACN 123 251 703 (‘Blackhawk’) is Indue’s program manager for the Bonus Gift Card.

12. The Promoter reserves the right to reclaim the Bonus Gift Card from any claimant, or to request payment for the value of the Bonus Gift Card where it has been partially or fully redeemed by the claimant or is no longer in the possession of the claimant, if an Eligible Product is returned (and the claimant receives a partial or full refund of the purchase price of the Eligible Product) after the claimant’s entry has been processed and the Bonus Gift Card has been dispatched.

13. If a claimant is under the age of 18 years, the Bonus Gift Card will be awarded to the claimant's nominated parent or guardian on the successful claimant’s behalf.

14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to disqualify any claimant, modify, suspend, terminate or cancel the promotion, as appropriate.

15. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees set out in the Australian Consumer Law of the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).

16. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a claimant; (e) taking/use of a reward or (f) any other way connected with this promotion.

17. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers (including such third parties who may be outside of Australia). Claiming is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.sony.com.au/section/privacypolicy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.   Claimants will also be required to provide their personal information to other third parties involved in this Promotion including The Consortium Clemenger Pty Limited who is engaged by the Promotor to help administer this Promotion, Indue Ltd, the issuer of the Bonus Gift Card and Blackhawk Australia Pty Ltd who is Indue’s program manager for the Bonus Gift Card.
